Terms & Conditions
1. Acceptance of these terms
By purchasing a license, downloading the installer, or otherwise using BuildYourMailer (the "Service"), you agree to these Terms & Conditions. If you do not agree, do not use the Service.
2. The service
BuildYourMailer provides a licensed installer for a self-hosted mail server, plus the license management system (activation, moves, renewals) that operates it. You run the software on your own server; we do not host, store, or process the email you send through it.
3. Licenses
A purchase grants a license, not ownership of the software, under the machines/moves/expiry terms shown on the plan you bought at the time of purchase (see the pricing page for what each plan includes). Editing or retiring a plan in the future never changes the terms of a license already issued under it. Licenses are for your own use; reselling, sublicensing or sharing a license key outside your organization is not permitted unless the plan you bought explicitly allows it.
4. Payments
All prices are shown and charged in the currency displayed at checkout, as a one-time payment for the term of the license purchased. [Placeholder: refund policy — e.g. "Refunds are available within N days of purchase if the license has not been activated on any machine."] Payments are processed by a third-party payment provider (currently Stripe); we do not receive or store your full card details.
5. Acceptable use
You are solely responsible for the email you send using a server installed with this Service. You agree not to use it to send unsolicited bulk email ("spam"), to send content that is illegal, fraudulent, or infringing, or in any way that violates applicable anti-spam law (e.g. CAN-SPAM, GDPR/ePrivacy, or your recipients' local equivalent). We may revoke a license used for abuse.
6. Intellectual property
The installer, licensing system, and related software remain our property (or that of our licensors). Your license grants a right to run the software under these terms — it does not transfer ownership, source code rights, or trademark rights.
7. Warranty disclaimer & limitation of liability
The Service is provided "as is," without warranty of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages (including lost email deliverability, lost revenue, or data loss) arising from your use of a self-hosted mail server, including issues with third-party infrastructure (your hosting provider, DNS, or recipient mail providers) outside our control.
8. Termination
We may revoke a license used in breach of these terms (in particular Section 5). You may stop using the Service at any time; amounts already paid are non-refundable except as described in Section 4.
9. Governing law
[Placeholder: these terms are governed by the laws of — fill in your company's jurisdiction.]
10. Changes to these terms
We may update these terms from time to time; the current version is always published at this address. Continued use of the Service after a change constitutes acceptance of the new terms.
